Effective Date: August 17, 2026

GYDED, LLC d/b/a GYDED Health

Your Information. Your Rights. Our Responsibilities.

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN ACCESS THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

GYDED, LLC d/b/a GYDED Health (“GYDED”) is committed to protecting the privacy and security of your health information.

This Notice of Privacy Practices explains how GYDED may use and disclose your Protected Health Information (“PHI”), your rights regarding that information, and our responsibilities under the Health Insurance Portability and Accountability Act (“HIPAA”) and other applicable federal and state privacy laws.

This Notice applies to health information created, received, maintained, or transmitted by GYDED in connection with psychiatric evaluations, medication management, telehealth care, billing, prescribing, and other healthcare services.

Get a Copy of Your Medical Record

You may ask to see or receive an electronic or paper copy of your medical record and other health information maintained by GYDED.

We will generally provide the information within 30 days of receiving your request, as required by law.

We may charge a reasonable, cost-based fee when permitted by law.

In limited circumstances, we may deny access to certain information. If access is denied, we will explain the reason and inform you of any rights you may have to request a review of that decision.

Ask Us to Correct Your Medical Record

If you believe health information in your record is incorrect or incomplete, you may request an amendment.

We may deny your request in certain circumstances, but if we do, we will provide an explanation in writing, generally within 60 days.

Request Confidential Communications

You may ask us to communicate with you in a particular way or at a particular location.

For example, you may ask that we:

  • Call only a specific telephone number.

  • Contact you through the patient portal.

  • Use a particular email address.

  • Avoid leaving detailed voicemail messages.

We will accommodate reasonable requests.

Ask Us to Limit What We Use or Share

You may ask us not to use or disclose certain health information for treatment, payment, or healthcare operations.

We are generally not required to agree to these requests, although we will consider them.

Services Paid in Full

If you pay for a healthcare service entirely out of pocket, you may ask us not to disclose information about that service to your health insurance plan for payment or healthcare operations.

We will honor that request unless disclosure is required by law.

Get a List of Certain Disclosures

You may request an accounting of certain disclosures of your health information made during the six years before your request.

The accounting generally will not include disclosures made for:

  • Treatment.

  • Payment.

  • Healthcare operations.

  • Disclosures you specifically authorized.

  • Certain other disclosures excluded by law.

We will provide one accounting during any 12-month period without charge. A reasonable fee may apply to additional requests during the same period.

Get a Copy of This Notice

You may request a paper or electronic copy of this Notice at any time.

You may receive a paper copy even if you previously agreed to receive the Notice electronically.

Choose Someone to Act for You

If another person has legal authority to act on your behalf, such as a legal guardian, healthcare power of attorney, or other authorized personal representative, that individual may exercise certain privacy rights for you.

We may require documentation establishing the person's authority before allowing the person to act on your behalf.

GYDED will not retaliate against you for filing a privacy complaint or exercising your privacy rights.

YOUR CHOICES

For certain uses and disclosures of your health information, you may tell us what you want us to do.

Family Members and Others Involved in Your Care

You may tell us whether we may share relevant information with:

  • Family members.

  • Close friends.

  • Caregivers.

  • Other individuals involved in your care or payment for your care.

If you are unable to communicate your wishes, we may share limited information when permitted by law and when we reasonably believe doing so is in your best interest.

We may also disclose information when necessary to prevent or reduce a serious and imminent threat to your health or safety or the health or safety of another person, when permitted by law.

Marketing

Most uses or disclosures of your PHI for marketing purposes require your written authorization.

GYDED does not sell your PHI.

Psychotherapy Notes

Most uses and disclosures of psychotherapy notes, as that term is specifically defined under HIPAA, require your written authorization.

Psychotherapy notes are different from the regular documentation contained in your medical record.

HOW WE MAY USE AND DISCLOSE YOUR INFORMATION

HIPAA allows GYDED to use or disclose your health information for certain purposes without obtaining a separate authorization from you.

Treatment

We may use and disclose your health information to provide, coordinate, or manage your healthcare.

For example, we may share appropriate information with:

  • Your primary care provider.

  • Therapist.

  • Psychiatrist.

  • Pharmacy.

  • Laboratory.

  • Other healthcare professionals involved in your treatment.

Information shared will be limited as required by applicable law.

Payment

We may use and disclose your health information to obtain payment for services.

This may include:

  • Verifying insurance coverage.

  • Submitting claims.

  • Responding to health-plan requests.

  • Coordinating benefits.

  • Collecting patient responsibility amounts.

  • Providing billing documentation.

If you are self-pay, information may also be used to process payment and provide receipts or superbills.

Healthcare Operations

We may use and disclose health information as necessary to operate GYDED.

Examples include:

  • Quality improvement.

  • Reviewing treatment and services.

  • Compliance activities.

  • Credentialing.

  • Licensing.

  • Auditing.

  • Billing administration.

  • Practice management.

  • Staff training.

  • Legal and professional consultation.

  • Technology and security operations.

Business associates who perform services involving PHI on behalf of GYDED are required to protect that information as required by applicable law and contractual agreements.

ABUSE, NEGLECT, AND SAFETY CONCERNS

We may disclose health information when required or permitted by law regarding suspected:

  • Child abuse or neglect.

  • Abuse, neglect, or exploitation of a vulnerable adult.

  • Domestic violence.

  • A serious threat of harm to you or another person.

Because GYDED provides behavioral-health services, additional federal and state confidentiality requirements may apply.

USES AND DISCLOSURES REQUIRING YOUR WRITTEN AUTHORIZATION

Uses or disclosures of PHI that are not otherwise permitted or required by law generally require your written authorization.

This includes, when applicable:

  • Most uses and disclosures of psychotherapy notes.

  • Most marketing uses involving PHI.

  • Sale of PHI.

  • Other disclosures not described in this Notice.

GYDED does not sell PHI.

If you give GYDED written authorization, you may generally revoke that authorization later in writing.

Revoking authorization will not affect actions already taken in reliance on the authorization.

MENTAL HEALTH INFORMATION AND NEW MEXICO LAW

Because GYDED provides behavioral-health services in New Mexico, certain mental-health information may be protected by state confidentiality laws in addition to HIPAA.

New Mexico law generally places additional confidentiality protections on certain mental-health and developmental-disability information and limits when identifiable information may be disclosed without authorization.

When New Mexico law or another applicable state law provides greater privacy protection than HIPAA, GYDED will follow the more protective requirement.

Certain exceptions may permit or require disclosures, including circumstances involving treatment, legal requirements, reporting obligations, emergencies, or serious safety concerns.

MINORS

Special privacy and consent rules may apply when GYDED provides services to patients under the age of 18.

Depending on the patient's age, the type of treatment, who consented to treatment, and applicable state and federal law:

  • A parent or legal guardian may have access to certain information.

  • A minor may have independent confidentiality rights regarding certain services.

  • Certain information may not be disclosed to a parent or guardian without the minor's permission.

  • Disclosure may nevertheless be required or permitted for safety, abuse reporting, emergencies, or other situations established by law.

GYDED will follow applicable law when determining who may authorize treatment, access records, or receive information about a minor patient's care.

SUBSTANCE USE DISORDER RECORDS

Certain substance-use-disorder records may receive additional confidentiality protections under 42 CFR Part 2.

To the extent GYDED receives or maintains records that are subject to Part 2, those records will be handled according to the additional protections required by federal law.

Part 2-protected records generally may not be used or disclosed in a civil, criminal, administrative, or legislative investigation or proceeding against you based solely on the information contained in those records unless the requirements of federal law have been satisfied, such as appropriate written consent or legally sufficient court process.

Additional restrictions may apply to redisclosure and other uses of Part 2 records.

OUR RESPONSIBILITIES

GYDED is required by law to:

  • Maintain the privacy and security of your PHI.

  • Follow applicable federal and state privacy laws.

  • Follow the privacy practices described in the current version of this Notice.

  • Provide you with this Notice.

  • Notify affected individuals when required if a breach occurs that compromises the privacy or security of unsecured PHI.

  • Honor your rights regarding your health information as required by law.

We will not use or disclose your health information in a manner not described in this Notice unless you authorize us to do so in writing or the law otherwise permits or requires the use or disclosure.

CHANGES TO THIS NOTICE

GYDED reserves the right to change the terms of this Notice and its privacy practices.

If this Notice is materially changed, the updated Notice will be made available on the GYDED website and upon request.

The current Notice will display its effective date.
